Terms of Service

1. Introduction and Acceptance

Welcome to Miximodel (miximodel.com), a subscription platform for models, artists, and creative professionals. Miximodel is operated by MakerLabs SARL, a French limited liability company registered under SIREN 942 958 216 ("we", "us", "Miximodel").

By accessing or using Miximodel, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the platform. We may update these terms from time to time, and your continued use of Miximodel after such changes constitutes acceptance of the updated terms.

2. Eligibility

You must be at least 18 years of age to create an account and use Miximodel. By registering, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement.

3. Account Terms

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

You must notify us immediately at contact@miximodel.com if you suspect any unauthorized use of your account.

4. Subscription and Billing

Miximodel offers both free and paid subscription plans. Paid plans are billed on a recurring basis:

  • Monthly Pro Plan: billed at the price displayed on the pricing page every month.
  • Yearly Pro Plan: billed at the price displayed on the pricing page once per year.

Auto-renewal: All paid subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current subscription price at the time of renewal.

Payment processing: Payments are processed by our third-party payment processors. Charges will appear as MIXIMODEL.COM on your bank or credit card statement.

By subscribing to a paid plan, you authorize us and our payment processors to charge your chosen payment method on a recurring basis until you cancel your subscription.

5. Cancellation and Refunds

You may cancel your subscription at any time from your billing settings. Upon cancellation, you will continue to have access to paid features until the end of your current billing period. No retroactive refunds are issued for partial billing periods.

6. Acceptable Use

Content standards

Miximodel permits artistic nude and erotic content (fine-art, editorial, and non-explicit erotic imagery) provided that: (a) the uploader is at least 18 years old; (b) every depicted person is at least 18 years old and has consented to publication; and (c) the content does not fall within the categories prohibited below.

The following content is strictly prohibited and will result in immediate removal and may result in account termination:

  • Explicit, pornographic, or hardcore material — any depiction of actual or simulated sexually explicit conduct as defined under applicable law (including 18 U.S.C. § 2256(2) and equivalent French and EU standards).
  • Child sexual abuse material (CSAM), in any form, without exception.
  • Non-consensual intimate imagery, deepfake nudity, or any depiction of a person who has not provided explicit consent to publication.
  • Content depicting minors in any sexualised, intimate, or vulnerable context.
  • Content that incites violence, terrorism, or hatred against any group.
  • Content that is illegal, defamatory, harassing, threatening, or otherwise violates applicable law or third-party rights.

Platform conduct

You also agree not to use Miximodel to:

  • Impersonate any person or entity, or falsely represent your affiliation.
  • Interfere with or disrupt the platform, servers, or networks connected to Miximodel.
  • Use automated means (bots, scrapers, etc.) to access or collect data from the platform without our written consent.
  • Engage in any activity that exploits, harms, or attempts to harm minors.
  • Violate any applicable law, regulation, or third-party rights.

We reserve the right to suspend or terminate accounts that violate these terms, without prior notice.

7. Intellectual Property

Your content: You retain ownership of all content you upload to Miximodel (photos, profile information, portfolio materials). By uploading content, you grant Miximodel a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute your content solely for the purpose of operating and promoting the platform.

Our platform: The Miximodel name, logo, software, and all related intellectual property are owned by MakerLabs SARL. You may not copy, modify, or redistribute any part of our platform without our express written permission.

8. Disclaimer of Warranties and Limitation of Liability

Miximodel is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the platform's reliability, availability, or fitness for a particular purpose.

To the maximum extent permitted by applicable law, MakerLabs SARL shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Miximodel, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claim arising from or related to these terms shall not exceed the amount you paid to Miximodel in the twelve (12) months preceding the claim.

9. Dispute Resolution

We encourage you to contact us first at contact@miximodel.com to resolve any dispute amicably. We are committed to finding a fair resolution for any issue you may encounter.

If a dispute cannot be resolved informally, it shall be submitted to the competent courts of Paris, France, unless mandatory consumer protection rules in your country of residence provide otherwise.

10. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of France. If you are a consumer residing in the European Union, you also benefit from the mandatory provisions of the consumer protection laws of your country of residence.

11. Termination

We may suspend or terminate your access to Miximodel at any time, with or without cause, and with or without notice. Upon termination, your right to use the platform ceases immediately. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, and governing law) shall survive.
