1. Parties and scope
This agreement is between MakerLabs SARL (SIREN 942 958 216), operator of Miximodel ("the platform"), and you ("the content provider"), for as long as you upload, generate, or publish any content on the platform.
It governs all content you place on the platform, whether you photographed it, created it, commissioned it, or generated it with the platform's tools. Accepting this agreement is required before any of your content is published publicly.
2. Lawful content and platform standards
You must not upload, generate, publish, or otherwise make available any content that is illegal under French law, under the law of your own country, or under the law of any country in which the content may reasonably be viewed.
You must not upload, generate, publish, or otherwise make available any content that violates the platform's content standards, as set out in the Terms of Service and the Moderation Policy. This includes, without limitation, any depiction of a minor in a sexual or suggestive context, any non-consensual content, any content depicting or promoting violence, coercion, trafficking, or bestiality, and any content you do not hold the rights to.
3. Consent of depicted persons
For every person depicted in your content, you must obtain their written consent before you upload it, and keep that consent on record for as long as the content remains on the platform. That written consent must cover all of the following:
- that the person consents to being depicted in the content;
- that the person consents to the content being distributed publicly, and specifically to it being uploaded to and displayed on this platform;
- that, where the content can be downloaded by others, the person consents to it being downloaded.
If a depicted person withdraws their consent, you must unpublish and remove the content concerned without delay.
4. Identity and age of depicted persons
For every person depicted in your content, you must verify their identity and their age, and satisfy yourself that they are an adult (at least eighteen years old, or older where the law applicable to them requires it) at the time the content was made. Content depicting anyone who is not an adult is prohibited without exception.
You must retain the documents on which you relied to verify identity and age, and you must be able to produce them to the platform on request.
5. Records and production on request
You must keep the written consents and the identity and age verification documents described above for as long as the content remains on the platform and for any longer period required by law applicable to you.
The platform may ask you to produce those records for any content you have uploaded, including where a complaint, a legal request, or a payment-processor enquiry concerns it. You must respond promptly. Content for which the records cannot be produced may be unpublished or removed.
Verifying and documenting the identity, age, and consent of depicted persons is your obligation, not the platform's. Nothing in this agreement makes the platform responsible for carrying out that verification on your behalf.
6. Acceptance and revisions
You accept this agreement by an explicit affirmative action — ticking the acceptance control below and confirming it. Acceptance is never assumed from your continued use of the platform, and no acceptance control is ever pre-ticked for you.
The platform records which version of this agreement you accepted and when. If the agreement is revised, you will be asked to accept the new version before your next publication. Content you published before a revision remains published.
7. Removal, suspension and termination
The platform may unpublish or remove any content, and may suspend or terminate your account, where it has reason to believe this agreement has been breached. That is in addition to any obligation the platform has to act under applicable law.
8. Operator
Miximodel is operated by MakerLabs SARL, SIREN 942 958 216, registered in France. Questions about this agreement, and the production of records requested under it, go through the contact route published on the Legal index.
